Notice and Take Down Mechanism

In compliance with Regulation (EU) 2022/2065 (Digital Services Act)

The Platform HeyStudent has established a Notice and Take Down Mechanism which allows Platform users to report the existence of suspected illegal content on the Platform, in compliance with Regulation (EU) 2022/2065 (Digital Services Act).

What is illegal content

The concept of illegal content is defined on the basis of the EU and national legislative framework. Indicative examples of illegal content include the following:

  • Infringement of intellectual property rights
  • Misleading information about a listing
  • Listings published without proper authorization
  • Non-compliant or illegal listings
  • Inappropriate content, such as content that may be offensive, discriminatory, terrorist, content that promotes violence or discrimination, or content that promotes hate speech, sexual harassment or abuse
  • Hidden advertising or commercial communication
  • Misleading/illegal information
  • Non-authentic user reviews

How to report the suspected illegal content — Single Point of Contact

Users may submit a report of suspected illegal content by sending an email to the email address legal@heystudent.com.

By submitting a report, the reporting party agrees that the report is submitted in good faith and that the information reported is true, accurate, and complete.

This email address serves also as a Single Point of Contact for Member State authorities (for sending orders to take action or orders to provide information on illegal content), the European Commission and the European Board for Digital Services.

Reports should be sufficiently detailed and accurate, clearly explaining why the content is considered to violate the law, and should be properly documented. Indicative information that should accompany the submission of a report includes: the type of alleged infringement, the link to the content on the Platform, any relevant photos, as well as explanation of the reasons why the information in question is suspected to constitute illegal content.

Information about the procedure

  • A confirmation of receipt will be sent to the reporting party's email address.
  • If a report lacks essential information, rendering it insufficiently accurate or properly documented, we may not be able to continue its examination or may request supplementary information.
  • We will examine and evaluate the substance of the report in order to take any appropriate action.
  • We may forward the report to any third party involved so that they can provide us with their opinion/explanation.
  • Where the content is manifestly illegal, we may take immediate action to deactivate/remove the content from the Platform.
  • In any case, our decision and the relevant reasons that led to such decision will be sent to the reporting party.
  • We will also notify the affected parties, such as any Host involved, providing a clear explanation of the circumstances on which the decision was based.

Appeal

In case that an affected party is not satisfied with a decision, they:

  • Have the right to submit a complaint to a certified (EU) out-of-court dispute settlement body.
  • May submit a complaint (appeal) within six (6) months to the email address: legal@heystudent.com, which has been designated for receiving relevant complaints within the Company's internal complaint management system.

Protection of personal data

In the context of the Notice & Take Down Mechanism, the Company collects and processes personal data directly from the reporting party, such as: full name, email address, and any other information included in the report.

The personal data collected when submitting reports is processed in accordance with the legislation on the protection of personal data for the purposes of evaluating the reports and notifying the parties involved of the Company's decisions. The processing of data is based on the Company's compliance with legal obligations, as well as on the protection of the legitimate interests of both the Company and the parties involved.

The relevant data and reports are kept by the Company for a period of five (5) years, unless legal proceedings have been initiated or the law provides otherwise.
